In a landmark decision that could significantly impact the cinema-going experience in India, PVR-INOX, one of the country’s largest multiplex chains, has been fined Rs 1 lakh by a consumer court in Bengaluru for running advertisements beyond the scheduled showtime. This ruling comes in response to a complaint filed by a Bengaluru resident, Mr. Abhishek MR, who alleged that the multiplex chain had engaged in unfair trade practices by screening excessive advertisements before the movie, thereby wasting his valuable time.

The Case: A Matter of Time and Consumer Rights

Mr. Abhishek MR, an advocate by profession, had booked tickets for the 4:05 PM show of the movie “Sam Bahadur” at PVR Cinemas in Orion Mall on December 26, 2023. However, instead of the movie starting at the designated time, the screening was delayed by nearly 30 minutes due to a barrage of advertisements and trailers. This delay caused Mr. Abhishek to miss a crucial work commitment, prompting him to take legal action against the multiplex chain.

In his complaint, Mr. Abhishek argued that the prolonged advertisement breaks constituted an unfair trade practice, as they not only wasted his time but also caused him mental agony and inconvenience. He further contended that the multiplex chain was unjustly profiting from these advertisements at the expense of its patrons’ time and comfort.

The Verdict: A Win for Moviegoers

After reviewing the evidence and hearing arguments from both sides, the Bengaluru Urban District Consumer Disputes Redressal Commission ruled in favor of the complainant. The commission held that PVR-INOX had indeed engaged in unfair trade practices by screening advertisements beyond the permissible time limit. It emphasized that viewers should not be forced to endure lengthy advertisement breaks, especially when they have paid for a specific showtime.

The commission’s order stated, “In the new era, time is considered as money, each one’s time is very precious, no one has the right to gain benefit out of others’ time and money. 25-30 (minutes) is not less to sit idle in the theatre and watch whatever the theatre telecasts. It is very hard for busy people with tight schedules 1 watching unnecessary advertisements. However, they make their own arrangements to get some relaxation with family.

Punitive Damages and Compensation

In its ruling, the consumer court directed PVR-INOX to pay Rs 1 lakh as punitive damages to the Consumer Welfare Fund. Additionally, the multiplex chain was ordered to pay Rs 20,000 to Mr. Abhishek as compensation for the mental agony and inconvenience he suffered, along with Rs 8,000 to cover the costs of filing the complaint.

The commission also issued a stern warning to PVR-INOX and other multiplex chains, directing them to strictly adhere to the prescribed time limits for advertisements and to ensure that movie tickets clearly state the actual start time of the film, excluding advertisement breaks.
