Rudhra Technologies (hereinafter “Rudhra”) is the sole and absolute owner of, and maintains and operates the website growjustindia.com (hereinafter “GrowJust India”), contents whereof are made available via mobile phone application, social media, RSS feed and other digital services from time to time. You are required to regularly and carefully read these Terms of Use as well as the Privacy Policy which shall be treated as part of these Terms of Use. By accessing or using contents or services of GrowJust India, you confirm your knowledge and acceptance of these Terms of Use and agree to comply with and be bound by the same. Subject to these Terms of Use, Rudhra Technologies permits you to access and makes personal non-commercial use of contents and services of GrowJust India. Rudhra Technologies reserves the right to revise these Terms of Use at any time at its sole discretion by posting revised Terms of Use on GrowJust India, without any other or further notice to you.

You are prohibited from modifying, publishing, reproducing, transmitting, distributing, performing, displaying in any form, communicating to public, creating derivative works or participating in the transfer or sale of any of the contents in whole or in part except judgments, orders, notifications, circulars and laws, which may be downloaded or copied and used for personal and non-commercial purposes without modifying in any manner any content, watermark, notice or trademark added to it by GrowJust India and by giving due credit to GrowJust India.
In addition to what is stated above, you warrant and agree that you will not
- Violate any law while using GrowJust India.
- Use, upload, post, email, transmit or otherwise make available any content or comment that is untrue, inaccurate, incomplete, unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, invasive of another’s privacy, hateful or otherwise objectionable.
- Harm, influence or make inappropriate contact or seek to harm, influence or make inappropriate contact with minors or vulnerable persons in any way.
- Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content of GrowJust India.
- Impersonate any person or entity, including, official, office bearers of Rudhra Technologies, or otherwise misrepresent your affiliation with a person or entity.
- Use, upload, post, email, transmit or otherwise make available any content or comment that infringes or passes off or harms or seeks to harm any patent, trademark, service mark, trade secret, brand, copyright or other proprietary rights or personal rights of any party.
- Use, upload, post, email, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships.
- Use, upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, false or fraudulent advertising, spam or any other form of solicitation.
- Use, upload, post, email, transmit or otherwise make available any content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.
- Use, upload, post, email, transmit or otherwise make available any content which threatens the unity, integrity, defence, security and/or sovereignty of India or its boarders, friendly relations with foreign states, or public order or causes incitement to the commission of any offence or prevents investigation of any offence.
Limitation of Liability
Rudhra Technologies shall not be liable, at any time for damages (including, without limitation, damages for loss of business projects, loss of savings, loss of revenue, loss or loss of profits) arising in contract, tort or otherwise from the use of or inability to use GrowJust India, or any of its contents, or from any act or omissions as a result of using GrowJust India or any such contents or for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of information contained on GrowJust India. No representations, warranties or guarantees whatsoever are made as to the accuracy, adequacy, reliability, completeness, suitability or applicability of the information to a particular situation. Rudhra Technologies, its subsidiaries, affiliates, directors, partners, shareholders, employees, representatives, advertisers or content providers, shall not be liable to you or anyone else as a result of your access of GrowJust India for indirect, special, incidental, punitive or exemplary damages. You agree to indemnify and hold Rudhra Technologies, its subsidiaries, affiliates, their directors, partners, shareholders, officers, employees and representatives, harmless from any claim, demand, loss, cost, liability, expenses or damage, including reasonable legal fees and cost of litigation, asserted by any third party due to or arising out or connected with your access/use of GrowJust India.

Termination
Rudhra Technologies may, at its sole discretion, terminate or suspend your access to all or part of GrowJust India for any reason, including, without limitation, breach of any of the terms of these Terms of Use.
General
Failure or delay in enforcing any provision of these Terms of Use by you shall not in any way constitute a waiver by Rudhra Technologies of its right to enforce any terms or conditions of these Terms of Use subsequently. Nothing in Terms of Use shall constitute any partnership or agency relationship between you and Rudhra Technologies. If you access or use GrowJust India from outside India, you shall do so in compliance with these Terms of Use and the laws of your location, at your own risk.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of India. In the event of any dispute between the parties, such dispute shall be settled through arbitration by a single arbitrator appointed by Rudhra Technologies in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be at Meerut and the language of arbitration shall be English. Any award rendered pursuant to such arbitration shall be final, binding and conclusive.
